Azlan Bin Sulaiman

Azlan Sulaiman was a government scholar who graduated from the University of East Anglia, Norwich, England with an LL.B (Hons) in 1988. He returned to Malaysia and received his Certificate in Legal Practice in 1989. He was then called to the Malaysian Bar on 17 August 1990.

From 1990 until the present, Azlan has been involved in the area of commercial, civil and corporate litigation. His areas of practice include banking (Islamic and conventional); leasing and hire-purchase; commercial contracts; corporate and shareholders’ disputes; debt collection; goods sold and delivered; bankruptcy & company insolvency; foreclosure; land-related disputes; trusts; land acquisition; leases and tenancy disputes; libel & slander; torts. Over the past few years he has also ventured into the area of arbitration and alternative dispute resolution.

Azlan has been appointed to represent the Bar Council in membership and disciplinary disputes. He has also been appointed by the Bar Council to deliver talks to pupils in chambers in the Professional Etiquette programs.
Prior to joining Azmi & Associates as a Partner, Commercial Litigation in January 2005, Azlan was a partner with Messrs. Allen & Gledhill.
His notable assignments include, amongst others:

  1. Represented corporations in arbitrations conducted at the Kuala Lumpur Regional for Arbitration and at the Singapore International Arbitration Centre.
  2. Assisted in arbitration on behalf of a Malaysian public listed company against a foreign company, conducted at the LCIA Court, and in the enforcement of the resultant Award in several international jurisdictions.
  3. Advised and represented Tenaga Nasional Berhad in defending and prosecuting claims under the Electricity Supply Act, 1990 arising from land acquisitions, installations, supply lines, way-leaves and all ancillary and related issues.
  4. Advised and represented TNB in prosecuting claims for damage to cables and installations
  5. Lead Counsel for Tanah Sutera Development Sdn Bhd v Pentadbir Tanah Daerah Johor Bahru in Court of Appeal Civil Appeal No: J-01-44-1997, an appeal against the decision of the Johor Bahru High Court on a Land Reference in which the primary issue to be decided was whether the Court of Appeal had jurisdiction to transfer the appeal to the Federal court.
  6. Advised and represented various local and foreign banks and financial institutions at all levels of the Malaysian Courts in the successful recovery of banking facilities, including the foreclosure of properties charged and / or assigned, winding-up, bankruptcy, appointment of receivers, etc.
  7. Has also advised and represented the same banks and financial institutions in defending claims, including one of Malaysia’s largest commercial banks in successfully defending brought by a prominent Malaysian businessman.
  8. Advised and represented a State Water Authority in respect of a major Water Supply Project in the state. Action taken includes contesting injunction proceedings, applying to strike out proceedings, and prosecuting claim against a prominent local bank for its refusal to honour the demands made by the State Water Authority on the performance guarantee and advance payment guarantee issued by the bank in its favour.
  9. Advised and represented a prominent local businessperson in the successful recovery of substantial monies personally advanced for the import of foreign vehicles into Malaysia.
  10. Advised and represented local major telecommunications company in applying to set aside a multi-million-ringgit arbitration award.
  11. Advised and assisted in successfully defending a claim against Malaysia Airlines brought by an American aviation company by way of an arbitration conducted at the LCIA Court. Further provided legal advice and representation on numerous other issues.
  12. Advised and represented a prominent timber company in defending a claim brought by a local timber concessionaire.
  13. Advised and represented a prominent local car manufacturer and its distribution and marketing subsidiary in a host of various legal issues.
  14. Advised and represented several local public listed companies, property developers and co-operatives in the satisfactory resolution of disputes in the Courts and/or by way of arbitration.
  15. Advised and represented Majlis Amanah Rakyat (MARA), Petronas and other corporations and bodies in the recovery of monies advanced as study loans and scholarships.
  16. Advised and represented the Bar Council in Court on disciplinary and membership disputes with members. Has also served on the Compensation Fund Adjudication Panel to adjudicate claims.
  17. He has contributed articles to numerous local and foreign legal publications.
